The Job Creators Network (JCN) on Saturday called for a complete reversal of President Joe Biden’s vaccine mandate, after members of the federal judiciary blocked the measure.

A three judge panel at the U.S. Court of Appeals for the Fifth Circuit granted a temporary stay against the broad mandate, citing “cause to believe there are grave statutory and constitutional issues with the Mandate”

If fully enacted, the mandate would require companies with 100 employees to mandate coronavirus vaccinations or provide weekly testing.

“We applaud the court’s swift action on issuing the stay in the 5th Circuit but it is paramount that all businesses, regardless of location, be able to breathe at least a temporary sigh of relief. For that reason, we filed with the 8th Circuit this afternoon asking to enforce the suspension of the mandate nationwide. President Biden is completely out of touch with reality and is under the misguided impression that this unconstitutional mandate will not have a detrimental impact on the small business community. We know better and we will continue to fight until it is completely eliminated,” said Alfredo Ortiz, president and CEO of JCN.

Previously, the group also announced a lawsuit against the Biden administration just hours after the announcement that a COVID-19 vaccine mandate for companies will take effect on January 4.

However, after the ruling, the Biden administration doubled down on their attempts to force a mandate, detailing that they are ready to defend the measure in court.

“The Occupational Safety and Health Act explicitly gives OSHA the authority to act quickly in an emergency where the agency finds that workers are subjected to a grave danger and a new standard is necessary to protect them,” said Seema Nanda, the Labor Department’s top legal adviser, noted by The Wall Street Journal.
